Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus, directing the respondent to dispose of the petitioner's representation dated 10.01.2015 in the light of G.O.Ms.No.347, School Education Department dated 15.09.1998 and award Secondary Grade Assistant Scale of pay by counting the petitioner's entire Higher Grade Services on part with secondary Grade Scale of pay and accordingly pay the revision of pension with all its arrears to the petitioner. ORDER

The petitioner was initially appointed as a Higher Grade Teacher in a Panchayat Union Middle School on 07.02.1969. According to the petitioner, he was in possession of the requisite qualification for appointment to the post of Secondary Grade https://hcservices.ecourts.gov.in/hcservices/

Teacher. Thus, subsequently, on 02.10.1973, he was absorbed as a Secondary Grade Teacher. He is now retired from service. He sent a representation dated 10.01.2015 to the respondents requesting for fixation of Secondary Grade Assistant scale of pay by counting the petitioner's higher grade services. The grievance of the petitioner is that his representation has not yet been considered by the respondent. Hence, he has come forward witht his writ petition seeking a direction to the respondents to dispose of his representation dated 10.01.2015 in the light of G.O.Ms.No.347, School Education Department dated 15.09.1998.

2. I have heard the submissions made on either side.

Considering the limited scope of the prayer and taking into consideration of the fact that the representation of the petitioner dated 27.05.2015 is pending, without going into the merits of the case, the 1st respondent is directed to consider the representation of the petitioner dated 10.01.2015 in the light of the Government Order referred to above and pass orders on merits and in accordance with law within a period of four months from the date of receipt of a copy of this order. This writ petition is, accordingly, disposed of. No costs.
