ORDER : The Court Made the following order :- The petitioner, who was arrest at the hands of the respondent police on 08.02.2022 for the alleged offences under Sections 5(l),(m) read with 6 of POCSO Act, 2012 @ 366, 344, 376 A,B and Section 5(l),(m) read with Section 6 of POCSO Act, 2012 in Crime No.07 of 2021 seeks bail.
2. The petitioner herein had committed penetrative sexual offence on a minor child. The mother of the minor child had found abnormal physical changes in the private part of the minor child had reported the case to the police and on medical examination, the child was found to have been sexually abused.
3. On perusal of the statement of the victim recorded under section 164 Cr.P.C reveals that the victim has made categorical allegations against the petitioner to the effect that sexual acts were perpetrated by the petitioner who is aged about 29 years. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl. Side) submits that the respondent police has completed the investigation and filed a final report and further the matter is ready for trial.
5. In view of the facts and circumstances of the case, this Court is of the opinion that if the petitioner is granted bail, there is every possibility of tampering the evidence. Hence, this Court is declined to entertain the bail petition.
