M.SUNDAR.J., and K.GOVINDARAJAN THILAKAVADI, J., (Order of the Court was made by M.SUNDAR, J.,) Captioned 'Writ Miscellaneous Petitions' [hereinafter 'WMPs' in plural and 'WMP' in singular for the sake of brevity] have been filed with a prayer to dispense with production of 'notice dated 16.10.2024 under Section 6 of Tamilnadu Land Encroachment Act, 1905 and the subsequent Notice dated 18.02.2025 issued by the fifth respondent' [hereinafter 'impugned notices' for the sake of brevity, convenience and clarity].
2. Learned counsel for writ petitioners adverting to the support affidavit submitted that original impugned notices were not readily available with the petitioners and therefore, petitioners were not able to produce original impugned notices. Learned counsel drew the attention 1/3
of this Court to a portion of Paragraph 14 of the support affidavit of one M.SUNDAR.J., and K.GOVINDARAJAN THILAKAVADI , J., gpa of the writ petitions and the same reads as follows: '11. I submit that original impugned notice dated 16.10.2024 issued by the 5th respondent under Section 6 of the Act and the subsequent impugned notice dated 18.02.2025 issued by the 5th respondent under Section 7 of the Act are not readily available to me. Therefore, I am filing the present writ petition with photo copy of the same........
3. Considering the facts and circumstances of the case on hand and taking note of the nature of the matter, aforementioned reason is accepted.
4. In the light of the narrative thus far, dispense with prayer is acceded to. Captioned WMPs are ordered as prayed for. [M.S.J.,] [K.G.T.J.,] 20.03.2025 gpa (2/2) 2/3
