PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay the petitioners interest for the belated payment of PF, Gratuity and Earned Leave Salary at the rate of 12% per annum within a specified time fixed by this Court. 1/4

ORDER

The writ petition is filed seeking a mandamus to the respondent to pay the interest @ 12% for the terminal benefits namely, PF, Gratuity and Earned Leave Salary, paid to them belatedly.

2. It is the case of the petitioners that they had worked in the respondentCorporation and had retired from service in the year 2024. The respondents have not settled the retiral benefits to them on the date of their retirement, and the same was paid to them after a delay of 1 1⁄2 months. Therefore, the respondents are legally bound to pay the interest to him. The petitioners made individual representations to the respondents in December 2025, to pay the interest at the rate of 12% p.a., for the belated payment. Since the same was not considered to date, the petitioners are before this Court.

3. The learned Standing Counsel appearing for the respondent would 2/4

fairly submit that the respondent-Corporation is willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

4. Heard the learned Counsel on either side and perused the materials available on records.

Considering the case of the petitioners, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioners, within a period of four weeks from the date of receipt of a copy of this order.
