Application is to grant leave to amend the plaint seeking damages for alleged infringement of copy right said to have been caused by the defendant being a continuous cause of action.

2. The learned counsel for the plaintiff seeks to amend the plaint seeking damages as an additional relief in the present suit instead of fresh suit to avoid multiplicity of litigation.

3. On the side of the defendant seeks leave to file an additional written statement if the plaint is amended.

4. Considering the nature of the facts pleaded, the application is allowed. The defendant is permitted to file additional written statement if any within a period of 30 days from today.

5. The Registry is directed to carry out necessary amendment in the plaint. The plaintiff is directed to file clean copy of the amended plaint.

6. Call the matter on 23.07.2021.
