This petition has been filed under Section 5 of the Limitation Act to condone the delay of 123 days in filing the above appeal against the order dated 02.09.2015 passed in C.M.P.No.2259 of 2010 on the file of the Judicial Magistrate Court, Sathyamangalam.

When this petition was taken up for hearing, the learned counsel for the petitioner sought permission of this Court to withdraw this petition.

In view of the above, the Criminal Miscellaneous Petition is dismissed as withdrawn with liberty to the petitioner to work out his remedy in the manner known to law. Consequently, Criminal Appeal SR No.10820 of 2016 is closed.
