ORDER

(The case has been heard through Video Conferencing) Earlier, this Court, by an order dated 01.07.2020, directed the respondent to conduct an enquiry and if any prima facie case is made out against the petitioners, directed to register FIR or close the petition itself within a period of two weeks.

2. When the matter is taken up today, the learned Additional Public Prosecutor (Puducherry) would submit that the petition enquiry is pending against the petitioners in Crime Not known of 2020.

3. The respondent Police has to issue notice under Section 41(A) of Cr.P.C., to the petitioners. The petitioners are directed to appear before the respondent Police and the Investigating Officer has to conduct the enquiry by strictly following the procedures therein. Officer has grounds to arrest the petitioners, then he has to state the reasons in writing and communicate the same to the petitioners and in that case, the petitioners are at liberty to file necessary applications before this Court seeking anticipatory bail.

4. With this observation, this Criminal Original Petition is closed.
