S.SANTHOSH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 406, 409 and 420 of IPC in Crime No.67 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner, who has promised to supply peppermint to the Government, received a sum of Rs.74,00,000/-, has failed to supply the same and has also not returned the money. The intention of cheating has led to the filing of criminal complaint by the defacto complainant, who has paid Rs.75,00,000/- to the first accused and the first accused, in turn, has transferred Rs.74,00,000/- to the petitioner herein.

3. The learned Government Advocate appearing for the respondent submitted that the petitioner had supplied the peppermint less than one third value of the money received, is before this Court, seeking anticipatory bail.

4. However, from the records available on record, this Court finds that, the custodial interrogation is required for further investigation and hence this Court is not inclined to grant anticipatory bail to the petitioner.
