This petition has been filed to condone the delay of 452 days in filing the above CMA.SR.No.42813 of 2025.

2. Notice to the respondents 1 and 3 already dispensed with.

3. Mr.D.Nitin, learned counsel takes notice for the 2nd respondent.

4. Though notice served on the 4th respondent and its name appear in the cause-list, there is no representation for the 4th respondent.

5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the 4th respondent.

6. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, delay is condoned. C.M.P.No.7333 of 2025 is allowed.

7. The Registry is directed to number the civil miscellaneous appeal and list the matter for admission, if it is otherwise in order.

8. The Registry is further directed to print the name of Mr.D.Nitin, as counsel for the 2nd respondent in the cause-list at the time of admission.
