This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 27.12.2024, seeking bail in Crime No.160 of 2024 registered for the offence under Section 8(c), 22(c), 29(1) of the NDPS Act.

2.The case of the prosecution is that on secret information, the petitioner/A1 along with other accused was found to be in possession of 52 grams of Methamphetamine.

3.Learned counsel appearing for the petitioner submitted that the 1/4

petitioner is an innocent person and he has been falsely implicated in this case; that the petitioner is an young man, aged about 26 years; that the petitioner is in custody from 27.12.2024 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.Learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, submitted that the petitioner was found in possession of 52 grams of Methamphetamine, which is a commercial quantity and hence, rigors of Section 37 of the NDPS Act, would be applicable.

5.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) for the respondent Police and perused the materials available on record.

6.The petitioner was found in possession of 52 grams of Methamphetamine. He has not satisfied the twin conditions under section 37 of the NDPS Act and hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 21.03.2025 sai To 2/4
