This application is filed to grant leave to the Applicant/Plaintiff to sue Respondents/Defendants 1 to 4, who reside outside the jurisdiction of theis Court.
2. Heard the learned Counsel Mr.V. Raghavachari appearing for the Applicant and the learned Senior Counsel Mr.P.R.Raman appearing for the Respondents, through video conferencing.
3. The main contention of the learned counsel for the applicant is that the respondents are tried to release the movie in the name of Plaintiff's parents Banumathi and Ramakrishna and it is involving personality right of the mother and father of the plaintiff and it is his contention that since the movie is likely to release on the web, it will have a serious impact on the personality right of the applicant parents. As the respondents are residing
outside the jurisdiction of this Court and web release will have a serious impact all over India including the jurisdiction of this Court and this Court is having jurisdiction to entertain the suit, the learned counsel sought leave to sue the respondents.
4. Considering the nature of the averments and the web release is likely to be made by the respondents, the telecast all over the world will have serious impact including the jurisdiction of the Court, maintaining the suit before this court cannot be questioned. Since the respondents are residing outside the jurisdiction of this Court leave is granted. Registry is directed to number the suit if it is otherwise in order and post the suit on 01.07.2020.
5. Learned counsel for the applicant is directed to serve the copies of the suit papers to the respondent. Considering the fact the the respondents are outside the jurisdiction, the counsel may file a counter statement instead of counter affidavit.
