Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to dispose of the petitioner's representation dated 13.03.2019 submitted to 4th respondent through online with regard to survey and patta name transfer in the name of petitioner in respect of his property of an extent of hectares 2.87.0 (Acre 6.87 cents), in Patta No.256, comprised in Punjai Survey No.259/2, Old Survey No.97-A, Gundri Village, Sathyamangalam Taluk, Erode District.

Mr.S.N.Parthasarathy, learned Government Advocate takes notice for the respondents. By consent of the parties the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner seeks for a Mandamus, directing the respondents to dispose of his representation dated 13.03.2019, wherein and whereby, he sought for survey of the property measuring an extent of hectares 2.87.0 (Acre 6.87 cents), in Patta No.256, comprised in Punjai Survey No.259/2, Old Survey No.97-A, Gundri Village, Sathyamangalam Taluk, Erode District and issuance of patta in his favour.

3. It is stated that the petitioner has purchased the subject matter property from one Mohamed Suroor Hussain by way of a sale deed dated 06.12.2018, registered as Document No.1253 of 2019 at the office of the Sub-Registrar, Sathyamangalam. It is further stated that the petitioner is in possession and enjoyment of the above said property from the date of purchase. Hence, the petitioner made an application on 13.03.2019, seeking for transfer of patta in his favour. However, the respondents have not considered the same. Hence, the present writ petition is filed.

4. Heard both sides.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the fourth respondent to consider and decide the same on merits and in accordance with law. Accordingly, this Writ Petition is disposed of, only by directing the fourth respondent to consider the application of the petitioner dated 13.03.2019 and pass orders on the same on merits and in accordance with law. Such exercise shall be done by the fourth respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
