Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus, directing the 3rd respondent to consider the petitioner's representation dated 10.04.2015 to sanction the third incentive increment to the petitioner acquiring M.Phil., Degree in the light of G.O.(2D) No.15, School Education (J) Department, dated 28.03.2013 within a time frame to be fixed by this court.

ORDER

The petitioner is a Graduate Assistant Teacher. He is Post Graduate in Physics and Education. He is now working under the control of the 3rd respondent. Earlier he was granted first and second increment on 09.12.2011 for having acquired Master Degree in Physics and Education. Now, he has acquired higher qualification viz., M.Phil., Degree in Education. According to the petitioner, for having acquired higher qualification, he is entitled for third increment as per G.O.(2D) No.15 dated 28.03.2013. In this regard, he has submitted a representation on 10.04.2015 to the respondent. The grievance of the petitioner is that so far his representation https://hcservices.ecourts.gov.in/hcservices/

has not been considered by the respondents. Hence, he has come forward with this writ petition seeking appropriate direction to the respondents for earlier disposal of his representation.

2. I have heard the submissions made on either side.

Considering the limited scope of the prayer and taking into consideration of the fact that the representation of the petitioner dated 10.04.2015 is pending, without going into the merits of the case, the respondents 2 and 3 are directed to consider the representation of the petitioner dated 10.04.2015 and to pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. This writ petition is, accordingly, disposed of. No costs.
