ORDER

This Criminal Original Petition has been filed to direct the respondent Police to register a case on the complaint dated 18.06.2016, given by the petitioner, based on which, petition enquiry in CSR.No.306 of 2016 is pending.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. On the complaint dated 18.06.2016, petition enquiry is pending in CSR.No.306 of 2016. On a reading of the complaint given by the petitioner, it is seen that the opposite party had borrowed Rs.1,50,000/- from the petitioner and that he is not returning it.

4. It is only to give a criminal colour to the complaint, the petitioner has stated that he has been intimidated by the opposite party. Since the dispute essentially appears to be civil in nature, no positive direction can be issued to the respondent-Police to register an FIR.

Hence, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
