Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the respondent in the proceeding in Rc.No.COP/Pen/1(1)/153/90751/2019 dated 13.01.2020 and quash the same and directing the respondents herein to disbursement in his DCRG Rs.5,65,950/- (Five lakhs sixty five thousand nine hundred and fifty rupees) along with the interest as per G.O.No.173 Finance (Pension) Department dated 01.04.2004 and grant the petitioner all consequential benefits and pass such further orders. 1/4

When the matter was taken up for hearing on 06.11.2024, there was no representation on behalf of the petitioner and the matter was directed to be listed on 11.11.2024. Again, on 11.11.2024, there was no representation for the petitioner. Hence, the Registry was directed to list the matter on 13.11.2024.

2. Even today, 13.11.2024, when the matter was taken up for hearing at 11.30 a.m., none appeared on behalf of the petitioner. It is made clear and evident that the petitioner is not interested in prosecuting the case.

3. Since there is no representation for the petitioner, this Court is left with no other option except to dismiss the petition for non-prosecution. In the result, the writ petition stands dismissed for NonProsecution. No costs. Consequently, connected miscellaneous petition is closed.
