This Original petition has been filed for succession certificate by the Legal Heirs of the deceased V.Venkataraman, who died on 08.01.2020 at Chennai.

The details of the securities for which the Succession Certificate is sought for is furnished in the schedule to the petition and its value is Rs.11,42,254/-, according to the petitioners. The daughter of the deceased viz., the first petitioner herein has deposed before the learned Master in support of this petition for succession certificate. Before the Learned Master, the following documents were marked as Exhibits. Exhibits Nature of the documents P1 Death certificate of V.Venkataraman P2 Legal Heirship Certificate dated 16.06.2020 for V.Venkataraman P3 Death certificate of V.Lalitha, wife of the deceased V.Venkataraman P4 Schedule of securities with value held by the deceased V.Venkataraman P5 Consent affidavit of V.Aishwarya viz. 1st petitioner P6 Paper Publication effected in one issue of Tamil Daily viz., Makkal Kural, dated 06.01.2022.

An averment has also been made in the petition that no application has been made to the District Court or delegate or to any High Court for Probate of any Will of the deceased or Letters of Administration with or without the Will annexed to his properties and credits. No application for Succession Certificate in respect of any debts or security belonging to the estate of the deceased has been made to any District Court or delegate or to any High Court. This Court has perused and examined the aforementioned documents. As seen from the death certificate marked as Ex.P1, V.Venkataraman, died on 08.01.2020 at F-1, Sri Krishna Apartment, No.9, Vallal Kumaran Street, Bagirathi Nagar, Madipakkam, Chennai 600 091 and he was aged 61 years at the time of his death. As seen from the Legal Heir ship certificate, dated 16.06.2020, marked as Ex.

P2, the petitioners are the only Legal Heirs for V.Venkataraman. The first petitioner is his daughter and the second petitioner is his son. Mrs.V.Lalitha, wife of the deceased V.Venkataraman, predeceased to him on 04.06.2017 and Ex.P Ex.P3 is death certificate of V.Lalitha.

Ex.P4 is the schedule of securities with value held by the deceased V.Venkataraman. The first petitioner has given consent for issuing succession certificate in favour of the 2nd petitioner and the consent affidavit of the first petitioner has been marked as Ex.P5. Paper Publication effected by the petitioners, pursuant to the directions given by this Court, in one issue of Tamil Daily viz., Makkal Kural, dated 06.01.2022 marked as Ex.P6.

After giving due consideration to the averments contained in the petition as well as the Exhibits marked on the side of the petitioners, this Court is of the considered view that the relief of succession certificate sought for by the petitioners in OP No.689 of 2021 has to be granted.
