PRAYER : This Criminal Original Petition filed under Section 482 of Cr.P.C., to direct the respondents herein not to harass the petitioner Trust members without due process of law at instance of any false and frivolus compliant in respect of practice of allopathy medicine as community health care provider (CHP) under legal provision of 2 (ee) (iii) of the Drugs and Cosmetics Rules 1945 while implementing Tamil Nadu clinical establishment (Regulations)rules-2018.

O R D E R

This Criminal Original Petition has been filed seeking for a direction to the respondents herein not to harass the petitioner.

2. It is the contention of the learned counsel for the petitioner that the respondents police harassing the petitioner under the guise of enquiry.

3. The learned Additional Public Prosecutor for the respondents 1 and 2 on instructions submitted that based on the complaint, notice has been issued to the petitioner. But the petitioner has not appeared before the second respondent for enquiry and he is not co-operating with the investigation.

4. Such being the position, it is for the investigating agency to issue appropriate notice to the petitioner for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation.

5. With the above direction, this Criminal Original Petition is disposed of.
