This petition has been filed to direct the 2nd respondent to execute the Non-Bailable Warrant issued against the 1st respondent in S.T.C.No.1720 of 2016 on the file of the learned Judicial Magistrate, Ootacamund, The Nilgiris. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the 2nd respondent. 3.The learned Additional Public Prosecutor submitted that the first respondent has filed a petition to recall the non-bailable warrant before the Court below and the same was recalled.

4.In view of the submission made by the learned Additional Public Prosecutor, the prayer sought for in this petition has become infructuous. Accordingly, the Criminal Original Petition stands dismissed as infructuous.
