2 LAKSHMI KANTHA [ RESPONDENT / DEFACTO COMPLAINANT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax Para No.9(c) the condition imposed by this Hon'ble Court in Crl OP No.1360 of 2022 dated 18.02.2022 relating to Crime No.18/2017 pending on the file of the respondent / respondent / complainant to To and pass such further order or any other orders as this Hon'ble Court may deem fit and proper in the circumstance of the case and thus render justice.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.HEMALATHA, Advocate for the petitioner and of MR.S.SANTHOSH, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner in Crl.O.P.No.1360 of 2022 dated 18.02.2022.
2.This Court, on 18.02.2022, while granting anticipatory bail to the petitioner imposed a condition that the petitioner should appear before the the respondent police on Saturday for a period of two months and thereafter as and when required for interrogation.
3. On perusal of a report submitted by the learned Government Advocate (Crl.Side) for the respondent/State shows that the petitioner had started complying the condition only from the first week of April and sofar reported before the Investigating Officer for a period of four weeks. As per the conditional order passed by this Court, the petitioner has to report before the Investigating Officer for the remaining period of four weeks.
4.Considering the nature of offence, this Court is not inclined to relax the condition earlier imposed on the petitioner.
