Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 1st respondent herein to consider and pass order in the appeal dated 24.12.2018 submitted by the petitioner in accordance with law and within a stipulated period.

Mr.E.Balamurugan, learned Special Government Pleader takes notice for the first and second respondents. Since this writ petition is being disposed of without affecting the interest of the respondents 3 to 6, notice to the said respondents is dispensed with.

2. The petitioner seeks for a mandamus directing the 1st respondent to consider and pass orders in the appeal dated 24.12.2018, wherein and whereby, he challenged the order passed by the second respondent granting joint patta in the name of the petitioner and the father's of the respondents 3 to 6.

3. The grievance of the petitioner is that the said appeal has not been considered by the 1st respondent so far.

4. This Court, at this stage, is not expressing any view on the merits of the appeal filed by the petitioner, as it is for the first respondent to consider and pass appropriate orders on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the 1st respondent to dispose of the appeal dated 24.12.2018 filed by the petitioner on merits and in accordance with law, after hearing the petitioner, the respondents 3 to 6 and the other interested parties, if any. Such exercise shall be done by the 1st respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
