Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent herein to consider and pass orders in the appeal dated 24.12.2018 submitted by the petitioner in accordance with law.

Mr.V.Prabhu, learned Government Advocate takes notice for the respondents 1 & 2. Since this writ petition is being disposed of, without affecting the interest of the respondents 3 to 7, notice to the said respondents is dispensed with. https://hcservices.ecourts.gov.in/hcservices/

2. The petitioner seeks for a mandamus directing the 1st respondent to consider and pass orders on the appeal dated 24.12.2018, wherein and whereby, he requested the 1st respondent to delete the names of the respondents 3 to 7, which was wrongly mentioned in patta Nos.870, 854, 464 & 258 and to issue separate patta in his favour.

3. Heard both sides.

4. The grievance of the petitioner before this Court is that the said appeal has not been disposed of by the 1st respondent so far.

5. This Court, at this stage, is not expressing any view on the merits of the appeal filed by the petitioner, as it is for the 1st respondent to consider and decide the same on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the 1st respondent to consider the appeal dated 24.12.2018 filed by the petitioner and pass orders on the same on merits and in accordance with law, after hearing the petitioner, the respondents 3 to 7 and other interested parties, if any. Such exercise shall be done by the 1st respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
