ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) of BNS 2023 (u/s 379 of IPC) r/w 21(1) Mines and Minerals (Development and Regulation) Amendment Act 1957 in Crime No.303 of 2025

on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners were involved in illegal transportation of two units of gravel sand without any valid permit or licence and that the petitioners were caught red handed by the respondent police. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners were innocent and that they have been falsely implicated in this case. He further submitted that they are is ready to abide by any stringent condition that may be imposed by this Court and are ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the A1 has got four previous cases and A2 has got one previous case against them. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

6. Considering the facts and circumstances of the case and taking into consideration of the nature of the allegation against the petitioners and the fact that the petitioners has got previous cases, the conduct of the petitioners in misusing the liberty, this Court is not inclined to enlarge the petitioners on anticipatory bail.
