Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to refer for the determination of the Court, under Section 20 of the Tamil Nadu Highways Act, as per the proceedings in Na.Ka.A4/1898/2022/Se.A.Sa.Thi/Kilanur/ Ne.A., dated 16.12.2022 with regard to the petitioner's property shown as serial numbers 68, 69, 70, 71 and 72 in the Award L.A.No.14/2021/Se.A.Sa. Thi/Kilanur/L.A. Dated 15.11.2021.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the respondent to refer for the determination of the Court under Section 20 of the Tamil Nadu Highways Act, as per the proceedings in Na.Ka.A4/1898/2022/Se.A.Sa.Thi/Kilanur/ Ne.A., dated 16.12.2022 with regard to the petitioner's property shown as serial numbers 68, 69, 70, 71 and 72 in the Award L.A.No.14/2021/Se.A.Sa. Thi/Kilanur/L.A. Dated 15.11.2021.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent and perused the materials available on record.

4. The grievance of the writ petition is that he had given representation on 07.02.2022 to refer the matter to the Tribunal under section 20 of the Tamil Nadu Highways Act, 2001. Though by the 2/5

proceedings 16.12.2022, the petitioner was informed that the matter will be referred to competent Court on the basis of seniority, till date, the matter has not been referred to the tribunal. Hence, the present Writ Petition.

5. On a perusal of the records, it is seen that award Order was served on the petitioner on 30.12.2021 and he has given representation to the respondent to refer the matter to the tribunal within 60 days from the date of receipt of the Order.

6. Considering the limited relief sought for in this writ petition, there shall be a direction to the respondent to consider the representation of the petitioner dated 07.02.2022 and refer the matter to the concerned Land Acquisition Tribunal within a period of two months from the date of receipt of a copy of this order.

7. With the above direction, this writ petition is disposed of. No costs.
