PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the 2nd respondent to conduct the enquiry in his summons Na.Ka.No.358/DCB/PLR/2022 dated 10.01.2023, by considering the representation of the petitioner dated 15.11.2023 on the file of the first respondent herein in accordance with law. 1/4

ORDER

This Writ Petition is filed for a mandamus, directing the 2nd respondent to conduct the enquiry in his summons Na.Ka.No.358/DCB/PLR/2022 dated 10.01.2023 by considering the representation of the petitioner dated 15.11.2023 on the file of the 1st respondent. 2.The learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 would submit that the respondents, during enquiry, sent summons to the 3rd respondent and he is yet to respond to the summons. He would submit that after due enquiry, they would take further action in accordance with law.

3.In view of the same, there shall be a direction to the 2nd respondent to conduct an enquiry and if any cognizable offence is made out on the basis of complaint lodged by the petitioner, take action in accordance with law. 2/4
