This writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the 1st and 2nd respondent to consider the representation made by the petitioner to the 1st and 2nd respondents dated 7.3.2023 and to protect the petitioner from the illegal actions of the 3rd respondent owing to her peaceful possession of her house situated at Brisly nagar.

ORDER

This writ of mandamus has been filed to direct the respondents 1 and 2 to consider the petitioner's representation dated 07.03.2023.

2. The grievance of the petitioner that she had already obtained a decree and judgment for permanent injunction in her favour in A.S.No.476 of 2005 on the file of VI Additional City Civil Court, Chennai. The third respondent herein, who is the petitioner's brother's wife, is allegedly causing disturbance. Hence, the petitioner seeks police protection.

3. Heard the learned Government Advocate (crl. Side) appearing for the respondents 1 and 2 and perused the materials available on record carefully.

4. Admittedly, the petitioner is having a decree in her favour. If there is any violation, she is at liberty to enforce the said decree in the manner known to law. There is no limitation for enforcement of the decree for permanent injunction. Hence, a blanket order of police protection cannot be granted.
