2.This writ petition has been filed seeking for a direction to respondents 1 and 2 to transfer the patta for the property, morefully described in the prayer to this writ petition, in favour of the petitioners, based on their representation dated 26.02.2025, within a time frame to be fixed by this Court. 3.The petitioners seek for transfer of patta in their name for the properties, morefully disclosed in the prayer to this writ petition. Based on a Civil Court judgment, the petitioners seek for transfer of patta. 4.Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 and 2. Mr.K.Vasanthanayagan, learned counsel for M/s.
Swaraj Associates, who accepts notice on behalf of respondents 5 and 6, submits that as against the Trial Court judgment passed in favour of the petitioners, an appeal has been filed by respondents 5 and 6 in A.S. Nos.12 & 13 of 2025 on the file of the Sub Court, Thiruvallur. He would submit that the petitioners are not entitled to get the transfer in their names. Since no adverse orders are being passed against respondents 3 to 10, notice to respondents 3 to 10 is dispensed with by this Court.
5.This Court is not expressing any opinion on the merits of the respective contentions.
6.No prejudice would be caused to respondents 1 and 2 if the petitioners' representation seeking for transfer of patta, as stated supra, is considered, on merits and in accordance with law, after hearing the objections of respondents 3 to 10, within a time frame to be fixed by this Court. 7.The objections that are raised by the learned counsel for respondents 5 and 6 before this Court can very well be raised before the first respondent when the first respondent is considering the representation seeking for transfer of patta in their name.
8.This Court is not expressing any opinion on the merits of the petitioners' representation. 9.For the foregoing reasons, this writ petition is disposed of by directing the first respondent to pass final orders, on merits and in accordance with law on the petitioners' representation dated 26.02.2025 seeking for transfer of patta in their name for the property, morefully described in the affidavit filed in support of this writ petition, after hearing the objections of respondents 3 to 10, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
