S.Mukanchand Bothra (Deceased) v. R.Krishnamurthy @ Kasthoori Raja

Crl.MP.No.5152 of 2023 in Crl.A.No.329 of 2015 and Crl.M.P.No.4345 of 2016 RMT.TEEKAA RAMAN.J The petitioner herein is the legal representative of the private complainant before the learned Judicial Magistrate in C.C.No.411 of 2013, which has resulted in acquittal and hence, during the life time of S.Mukanchand Bothra, he has preferred the Crl.A.No.329 of 2015. Pending appeal, the sole appellant died and his legal representative has filed this petition to continue the prosecution.

2. Since the factum of death and the petitioner being the legal representative of the sole appellant, are borne out from records, Crl.M.P.No.5152 of 2023, is allowed.

3. Registry is directed to amend the cause title in Crl.A.No.329 of 2015 and connected Miscellaneous Petition and post the appeal on 12.06.2023, for final disposal.
