ORDER

The wife has come before this Court seeking to transfer H.M.O.P. No.54 of 2013, filed by the husband for divorce before the Sub Court, Gingee, Villupuram District on the ground that she is residing along with her parents in Chennai, to the file of Family Court, Chennai. 2.Heard the learned counsel for the petitioner as well as the learned counsel for the respondent. Both parties are present. 3.This Court tried to conciliate the matter, however in vain. Taking into consideration the wife is residing along with her parents in Chennai and also the respondent doing agriculture in Villupuram District, it may not be possible for the respondent also to appear every hearing before the Family Court, Chennai, when the appearance of the parties is must.

4.Taking into consideration the difficulty of both parties, it is appropriate to transfer the H.M.O.P. No.54 of 2013, pending on the file of Sub Court, Gingee, Villupuram District to Sub Court, Tambaram instead of Family Court, Chennai.

5.The petition is ordered accordingly. However, there is no order as to costs.

Consequently, connected M.P. is closed.
