Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the records of the 1st respondent in his proceedings in Na.Ka.V7/2108411/2024 dated 10.1.2025 and quash the same and thereby forbear the respondents from converting the playground in S.No.225/7 (new S.No.225/97) - 0.80.65 out of 12.84.0 hectares at Pateeswaram Village, C.N.Palayam Panchayat, Cuddalore Taluk and District, for putting up any construction including construction for Jack Fruit Value Adding Centre.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The petitioner, who himself is an allottee of the land by way of a patta from the Government in the same area, has filed this public interest litigation challenging the action of the respondents in earmarking about 3 acres of land for developing of Jack Fruit Value Adding Centre.

2. There is no recorded playground. It appears that there is about 32 acres of land, which is recorded as hill area. However, a part of this land is allotted to the petitioner by way of patta. Having enjoyed patta over the same stretch of land, now the petitioner cannot turn around to challenge the establishment of Jack Fruit Value Adding Centre on the ground that it is a hill area.

We also place on record the undertaking given by the petitioner that the petitioner is prepared to surrender his land, if the same is required to establish the Jack Fruit Value Adding Centre. Petition does not appear to be in public interest and therefore, dismissed. There shall be no order as to costs. Consequently, the interim applications also stand dismissed.
