Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Certiorarified Mandamus calling for the records of the impugned order passed by the Debt Recovery Appellate Tribunal in R.A.No.40 of 2013 dated 29.12.2017 confirming the order of the Debts Recovery Tribunal, Madurai in T.A.No.207 of 2008 dated 25.05.2012 and quash the same and consequently direct the 1st respondent Bank to refund the sum of Rs.2,91,449/- and a sum of Rs.3,35,192/- to the respective petitioners together with interest fixed by this Court.

O R D E R

(Order of the Court made by M.DURAISWAMY,J.) Learned counsel appearing for the petitioners submitted that both the petitioners and the respondents have settled the matter before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras and also entered into Settlement Agreement. The learned counsel for the petitioners further submitted that https://hcservices.ecourts.gov.in/hcservices/

the writ petition may be disposed of in terms of the Settlement Agreement entered into between the parties. The learned counsel also produced a copy of the Mediation Report and the Settlement Agreement entered into between the petitioners and the respondents.

2. Learned counsel appearing for the first respondent Bank also submitted that the matter has been settled between the parties.

3. In view of the submissions made by the learned counsel appearing on either side, the writ petition is disposed of in terms of the Settlement Agreement entered into between the petitioners and the respondents. The Mediation Report and the Settlement Agreement shall form part of the record. No costs. Consequently, W.M.P.No.13285 of 2018 is closed.
