ORDER

This Writ Petition has been filed for the following reliefs:- "directing the 3rd respondent to consider the representation dated 18.2.2026 and 04.03.2026."

2. The case of the petitioner is that she is a native of Puducherry and belongs to the Scheduled Caste category. She had applied for the post of Nursing Officer at Indira Gandhi Medical College and Research Institute (IGMCRI) pursuant to the notification dated 07.10.2025. The petitioner had submitted her application on 10.10.2025 and was assigned Roll No. 10380.

3. On 14.01.2026, the provisional select list was published by the respondent institution. The petitioner's name was included at Serial No. 35 under the Scheduled Caste category. She had secured 84.850 marks out of 120. Her application had been duly scrutinised and accepted at all stages.

Subsequently, certificate verification was conducted. The petitioner attended the first round of verification on 27.01.2026. Thereafter, she had submitted fresh community and nativity certificates on 29.01.2026 as required by the authorities.

4. A second round of verification was scheduled on 13.02.2026 at 3:00 PM. However, the petitioner did not receive any communication whether by call, email, SMS, or any other mode informing her to attend the same. No reason was ever communicated to her for such omission.

5. The petitioner later came to understand that other selected candidates, including those belonging to reserved categories, have already been issued appointment orders. However, the petitioner has been excluded without any explanation, despite her valid inclusion in the provisional select list.

6. It is submitted that there exists an unrelated writ petition (WP.No.2692 of 2026) filed by another candidate, Mr. K. Muthuvel, the 4th respondent herein, concerning the grant of COVID marks, wherein an interim order was passed to keep one Scheduled Caste post vacant. The said case has no bearing on the petitioner's selection, which was independently finalized and free from any dispute.

Aggrieved by the inaction of the respondents, the petitioner had submitted a detailed representations dated 18.02.2026 and 04.03.2026 to the 3rd respondent, requesting clarification, completion of her verification, and issuance of appointment order. However, to date no action has been taken on the said representations. Hence the present Writ Petition.

8. Heard the learned counsel on either side and perused the records.

9. Considering the facts and circumstances of the case, the Writ Petition is allowed. The 3rd respondent is directed to consider and pass orders on the petitioner's representations dated 18.02.2026 and 04.03.2026 on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order. It is made clear that, while passing orders, the 3rd respondent shall not rely upon W.P. No. 2692 of 2026 filed by the 4th respondent herein, since the total number of seats is 35 and as per the orders passed in the said Writ Petition, only one seat is required to be kept vacant.
