ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326(a) of BNS Act and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.98 of 2025 on the file of the respondent police seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 1 unit of river sand in a tractor. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would reiterate the prosecution case and submit that the petitioner has one previous case. Hence, he opposed for grant of bail to the petitioner.

5. Considering the fact that petitioner has previous case, this Court is of the view that the petitioner does not deserve anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 25.03.2026 sma 2/4
