O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to consider the representation made by the petitioner on 05.12.2024, wherein the petitioner has sought for removal of the entry in the Encumbrance Certificate with respect to the document No.1355 of 2008 dated 28.02.2008 registered on the file of the third respondent.

2. Heard Mr.D.Ganeshprabhu, learned counsel for the petitioner and Mr.U.Baranidharan, learned Special Government Pleader for the respondents.

3. The learned counsel for the petitioner relied upon a communication dated 21.12.2024 made by the third respondent to the second respondent pursuant to the representation made by the petitioner seeking for removal of entry in the Encumbrance Certificate. The learned counsel submitted that till date the entry has not been removed and hence, the present writ petition has been filed before this Court. 2/4

4. The learned Special Government Pleader, based on written instructions received from the third respondent submitted that the representation made by the petitioner is under consideration and a decision will be taken shortly.

5. Taking into consideration the facts and circumstances of the case and the materials placed before this Court and also considering the submissions made on either side, there shall be a direction to the second and third respondents to act upon the representation made by the petitioner dated 05.12.2024 and to take a decision within a period of two weeks from the date of receipt of a copy of this order. The Writ Petition is disposed of with the above dirctions. There shall be no order as to costs.
