PRAYER : Petition filed under Section 11 of the Contempt of Courts Act, 1971 to initiate contempt proceedings against the respondents for non implementation of the directions and violated the same issued by this Court in W.P.No.4251 of 2024 by order dated 03.04.2024. For Petitioner:

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard.

2. Though this contempt petition was filed alleging willful disobedience of an order passed by this court on 3.4.2024, after going through the status report, affidavit, rejoinder and other materials which have been placed on record, we find that after the order was received, proceedings were drawn and order of sealing the premises was also passed, which is under challenge in various proceedings and even a writ petition was filed, wherein a direction

was issued that precipitative action should not be taken pursuant to the notice issued to the writ petitioner therein.

3. Therefore, we are not inclined to hold that it is a case of willful disobedience, so as to warrant any punitive action against the respondents.

Contempt petition is closed. Rule discharged. There shall be no order as to costs.
