In all cases For Petitioner(s):
Mr.M.Karthik For Respondent(s):
Ms.Kavya, Standing Counsel COMMON ORDER The writ petitions are filed for the below relief: "directing the respondent to pay 18 percentage per annum interest for the belated payment of terminal benefits from the date of retirement to till the date of actual payment made to petitioners within stipulated time.".
2. The brief facts which are culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioners that the petitioners worked as Sweepers in the respondent Corporation and retired from service. The respondent settled the terminal benefits with a delay. Therefore, the respondent is legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondent to pay the interest at the rate of 18% p.a., for the belated payment of the petitioners' terminal benefits. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the terminal benefits had been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interests on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondent to disburse the 6% interest for belated payment of benefits within a period of one (1) month from the date of receipt of a copy of this order. No costs.
