O R D E R

This Civil Revision Petition has been preferred seeking for a direction to dispose of the Suit in O.S.No.3903 of 2020 pending on the file of the XI Assistant Judge, City Civil Court, Chennai in a timely manner.

2. The revision petitioners/Defendants and the respondents/plaintiffs have filed a suit for declaration to declare the settlement deed dated 07.05.2020 as null and void.

3. Learned counsel for the petitioner submitted that the 1st revision petitioner is 70 years old senior citizen and hence, the suit has to be disposed as early as possible.

4. It is seen from the status report submitted by the learned XI Assistant Judge, City Civil Court, Chennai that the written statement of the defendants have already filed and the matter stands for framing of issues and posted to Page 2 / 4

28.06.2022. Only after the issues are framed, the trial can be commenced. Since, the plaintiffs have filed the suit, they should always be ready to conduct the suit as and when the Court directs. Since, the revision petitioners are the defendants and they also seek for early disposal of the suit, it will be appreciable, if the learned trial Judge gives shorter adjournments and facilitate for early disposal. Considering the age of the 1st defendant, a direction should be given to the learned trial Judge to dispose the suit as expeditiously as possible.

5. In the result, this Civil Revision Petition is disposed of and considering the age of the 1st defendant, the learned XI Assistant Judge, City Civil Court, Chennai is directed to dispose the Suit in O.S.No.3903 of 2020 as expeditiously as possible. No costs.
