ORDER
The petitioner, who was arrested and remanded to judicial custody on 05.12.2025 for the alleged offences under Section 7, 8 of POCSO Act, in Crime No.70 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner committed sexual assault on the defacto-complainant's daughter. Hence the case. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 05.12.2025. He stated that investigation
is over and the case is also taken on file. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police strongly opposed the bail application on the grounds of a serious sexual assault on the nine year old victim. He also produced the victim's statement recorded under Section 183 (3) the BNSS. 5.Taking into consideration of totality of the circumstances, the serious allegations against the petitioner, and upon perusal of the victim's Section 183 BNSS statement, this Court is of the firm view that the mental health of the minor victim would be adversely affected, if the petitioner is enlarged on bail. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
