2. Notice to first respondent is dispensed with since no relief is claimed against him.
3. The second respondent is represented through a counsel.
4. Heard learned counsel on either side.
5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 355 days in filing the above appeal is condoned.
6. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Ms.R.Rathna Thara, learned counsel for second respondent at the time of admission.
It is made clear that for the period of delay of 355 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
