Prayer : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the records of the 3rd respondent pertaining to the sale deed under Document No.4204 of 2014 dated 18.9.2014 with reference to property situated at T.S.No.1527/2, A.R.R. Road, Ward No.4, Kumbakonam Municipality executed in favour of the 5th respondent and quash the same and further direct the respondents 1 to 4 to restore the property to the original condition.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 4 and the learned counsel for the 5th respondent.

2. The petitioner has filed the present Writ Petition challenging the sale deed under Document No.4204 of 2014 dated 18.9.2014 with regard to property situated at T.S.No.1527/2, A.R.R. Road, Ward No.4, Kumbakonam Municipality executed in favour of the 5th respondent, however, for the very same property, the petitioner has already filed a 2/4

suit in O.S.No.136 of 2012 on the file of the learned Principal Sub Judge, Kumbakonam.

3. Accordingly, the present Writ Petition has become infructuous and hence, the writ petition is dismissed as infructuous with liberty to canvass all the points before the civil court. No costs. 04.09.2025 Index:Yes/No;
