ORDER

This writ petition has been filed for direction directing the respondents 2 and 3 to consider petitioner representation dated 16.05.2020 seeking not to remove the chicken shop run by the petitioner.

2. Heard and perused the materials available on record.

3. The petitioner is running a chicken stall for the past several years in the name and style of M/s Kannan Chicken Stall and got shop license from the second respondent. Even before the petitioner, his father was running the same chicken stall. While being so, on the complaint lodged by a neighbour, the respondents used to frequently visit the petitioner's chicken stall. Therefore, the petitioner submitted a representation not to cancel the license.

4. A perusal of the counter affidavit filed by the respondents and also on the submissions made by the learned counsel appearing for the

respondents revealed that the petitioner is running a chicken stall with due license. While being so, the neighbour lodged a complaint dated 19.10.2020, alleging that the petitioner had encroached some portion of the adjacent land belonging to the third respondent. However, on inspection, it was found that the petitioner is running a chicken shop without any corporation license.
