J U D G M E N T

(Order of the Court was made by G.Jayachandran J.) Intra-Court appeal is filed by the petitioner/appellant, being aggrieved by the order passed by the Learned Single Judge who dismissed the writ petition filed by him seeking the issuance of Writ of Certiorarified Mandamus.

The appellant herein claims that he and his friend, by name Velmurugan together entered into unregistered sale agreement with Sri Ambal Mills Limited and paid an advance of Rs.1,50,00,000/- in various instalments. But for various reasons including pending of litigations, the execution of the sale deed was delayed. In the meanwhile, the vendor mill, namely Sri Ambal Page Nos.2/6

Mills Limited was struck off from the register maintained by the Registrar of Companies for non-production of returns. In such circumstances, it is alleged that sale deeds dated 19.05.2022 and 25.05.2022 were registered in favour of one N.S.N.Natrajan. Knowing the said transfer of property, the appellant lodged a complaint before the authority to take criminal action. Consequentially, the present writ petition is filed to declare the said registration as unlawful and to conduct detailed enquiry.

3. The learned Single Judge, after considering the averments made in the affidavit, found that the petitioner/Velusamy has no locus to maintain the prayer sought in the writ petition. If at all, the petitioner had any semblance of right over the property as an agreement holder, his remedy is to seek specific performance of the agreement or recovery of the advance amount paid.

4. Aggrieved by the said order of the Learned Single Judge, the present appeal is filed.

5. Even admittedly the averments made by the petitioner is to be taken as tool, the issue raised is totally a civil dispute and the party has to work out his remedy before the competent Civil Court. That apart, based on an oral Page Nos.3/6

unregistered agreement, the writ petitioner seeks a declaration of a solemn act of registration as invalid, which is nothing but an abuse of the process of law.

6. The Learned Single Judge, having gone into the merits of the case, has rightly held that the writ petition is completely misconceived. The petitioner, who is not even a party to the agreement of sale, had approached this Constitutional Court to challenge a duly registered document.

7. We are of the considered view that the writ appeal is not only a consequence of misconceived litigation but abuse of the process of law.

8. Accordingly, the Writ Appeal stands dismissed. The appellant shall pay a sum of Rs.1,00,000/- (Rupees One Lakh only) to the Tamil Nadu State Legal Services Authority, High Court, Chennai, within a period of four months, from today.
