By consent the writ petition itself is taken up for final disposal.
2. The deponent of the affidavit is the mother of the writ petitioner, namely V.Sanjay Ashwin. He has written the +2 higher secondary examination which was held in March 2015 and the results were declared, in which he scored 1098 out of 1200 marks. The petitioner was issued with a temporary mark sheet. According to the petitioner, though he has performed well, he had not secured the required marks as he expected and hence, he applied for photo copy of the answer sheet and on verification of the photocopy of the answer sheet pertaining to Bio-Zoology (Subject Code -009), he found that though he was awarded 3 marks for Question No.27 and 2 marks for Question No.30 in Page No.5, while totaling page wise marks for the answer sheet Page No.5, he was awarded only 2 marks due to error in calculation and 3 marks obtained by him for https://hcservices.ecourts.gov.in/hcservices/
Question No.27 has not been taken into consideration. He would further state that though he applied for re-totaling, the result was given sustaining the very same mark. Aggrieved by the same, he has filed the present writ petition.
3.The learned counsel appearing for the petitioner drew the attention of this Court to Page No.5 of the xerox copy of the answer sheet and would submit that 3 marks awarded to Question No.27 has not been taken into consideration while totaling the page wise mark and hence, prays for appropriate orders.
4. Ms.Rajalakshmi, learned Government Advocate, who accepts notice on behalf of the respondent, would fairly submit that the petitioner is entitled to get three more marks as it was not taken into consideration while totaling the page wise marks.
5. In the result, the writ petition is allowed and the respondents shall award 62 marks in stead of 59 marks relating to Bio-Zoology (Subject Code-009) and make necessary correction in the temporary as well as original marks sheet bearing Registration No. 567936 and issue temporary mark sheet forthwith to the petitioner so as to enable him to participate in the counselling conducted by Centralised Admission Committee - CENTAC, Government of Puducherry on 25.06.2015.
No costs.
Consequently, the connected miscellaneous petition is closed.
