Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing the 1st respondent to give the status of the Look Out Circular bearing 2022427309 issued against the petitioner by the 1st respondent in respect of Crime No.458 of 2022 pending on the file of third respondent as soon as possible.

O R D E R

This Writ Petition has been filed seeking a direction to the first respondent to furnish the status of the Lookout Circular issued pursuant to the registration of the FIR in Crime No.458 of 2022.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2. Perused the materials available on record.

3. Based on the complaint, the second respondent registered an FIR in Crime No.458 of 2020 for the offences punishable under Sections 406 and 420 of IPC. At the time of registration of the FIR, the petitioner was residing in the United States of America. Consequently, the second respondent issued a Lookout circular in order to conduct enquiry as against the petitioner. After issuance of Lookout circular, it was acted upon. The petitioner is now residing in India. That apart, the second respondent has completed the investigation and filed the final report before the Judicial Magistrate No.II, Chengalpattu and the same has been taken cognizance in C.C.No.667 of 2023, which is pending for

trial. While being so, the petitioner filed a petition seeking permission to travel abroad. However, the same has not been taken on file.

The learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2 submitted that the investigation was completed, there is a possibility that the petitioner may be abscond and evade the trial. Therefore, Lookout circular issued as against the petitioner is still in force. After completion of the investigation and after filing final report, the pendency of the Lookout circular would not serve any purpose. In fact, the Lookout circular issued as against the petitioner has already been acted upon. However, there is apprehension that the petitioner may be abscond and evade the judicial process.

5. In view of the above, the second respondent is directed to keep the Lookout circular in abeyance. However, the petitioner is at liberty to seek permission before the Trial Court by filing affidavit containing relevant details, including the proposed place of stay abroad, a valid contact number and the tentative date of return to India, etc.

6. With the above direction, this Writ Petition stands disposed of. No costs.
