Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition made in Crl.M.P.No.8613 of 2016 in Crl.Appeal No.316 of 2016 vide order dated 01.09.2016.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.E.C.RAMESH, Advocate for the petitioner and of MR. R.RAVICHANDRAN, Govt. Advocate ( Crl. Side)on behalf of the Respondent the court made the following order:- According to the Petitioner/Appellant/A1, he is abiding the condition imposed by this Court in Crl.M.P.No.8613 of 2016 in Crl.A.No.316 of 2016 dated 01.09.2016 without any default till date. 2.In this regard, the Learned Sessions Judge, Mahila Court, Chennai, had addressed a communication dated 02.02.2017 inter alia stating that the Petitioner/Appellant/A1 is complying the conditions imposed by this Court in Crl.M.P.No.8613 of 2016 in Crl.A.No.316 of 2016 without any default.

3.These facts are not disputed on the side of the Respondent/ Complainant.

4.In view of the fact that the Petitioner/Appellant/A1 is abiding the conditions imposed by this Court on 01.09.2016 in Crl.M.P.No.8613 of 2016 in Crl.A.No.316 of 2016 without any default till date, this Court, taking note of the fact that the Petitioner is finding it difficult to appear before the Sessions Judge, Magaleer Needhi Mandram (Mahila Court), Chennai, on all working days at 10.30 a.m. and also that, he has an aged father, who is reportedly suffering for survival, this Court, relaxes the condition imposed in Crl.M.P.No.1423 of 2016 in Crl.A.No.316 of 2016, by directing the Petitioner to appear before the Sessions Judge, Magaleer Needhi

Mandram (Mahila Court), Chennai, once in a month on the First Working day of every English calendar month at 10.30 a.m. without fail pending Appeal, until further orders.

6.Accordingly, the Crl.M.P.No.1423 of 2017 is ordered. -sd/- 03/02/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
