( Criminal Jurisdiction ) Friday, the Twenty Fourth day of August Two Thousand Eighteen PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.11160 of 2018 IN CRL RC.428/2018 R.MURUGESAN, [ PETITIONER/APPELLANT] Vs G.ARTHANARESSWARAN [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to extension of time for the order passed in Crl.M.P.No.5272/2018 dated 28/03/2018 and also extend the time for deposit of the cheque amount.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.J.STALIN, Advocate for the petitioner the court made the following order:- The petitioner/Accused filed this Crl.M.P.No.11160 of 2018, to extend the time granted in the order passed in Crl.MP.No.5272 of 2018, dated 28.03.2018 and also to extend the time for depositing the cheque amount.

2. By an order dated 28.03.2018, the petitioner was convicted for the offence under Section 138 of the Negotiable Instruments Act and sentenced to undergo one year simple imprisonment and to pay of fine of Rs.5,000/- in default to undergo three months simple imprisonment. This Court granted the suspension of sentence to the petitioner with condition to deposit 50% of the cheque amount to the credit of the S.T.C.No.266 of 2014 on the file of the learned Judicial Magistrate (Fast Track Court No.II), Erode.

3. As the petitioner/Accused suffered from Jaundice, the petitioner could not deposit 50% of the cheque amount within the time. Hence, the petitioner/Accused seeks permission of this Court for depositing 50% of the cheque amount as earlier directed by this Court.

4. Having regard to the above submission, time is hereby extended by another period of two weeks. If the petitioner/Accused fails to deposit 50% of the cheque amount within a period of two weeks from https://hcservices.ecourts.gov.in/hcservices/
