ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) and 326(a) of BNS, 2023 r/w.21(1) of Mines and Minerals Act, 1957 in Crime No.106 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had illegally transported quarter unit of sand from lake without obtaining valid permit. Hence, this case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent persons and he has been falsely implicated in this case and is ready to co-operate with the investigation and also ready to abide by any conditions that may be imposed by this Court. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner along with other accused have illegally transported quarter unit of sand from river beds and that the petitioner has three previous cases registered against him.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. From the submissions made by the learned counsel Government Advocate, it is evident that the petitioner has three previous cases to his credit and that he had fled from the scene of occurrence and that quarter unit of sand

were illegally transported from the lake without any licence or valid permit. Natural resources are required to be protected. In the case on hand, the petitioner, without obtaining the necessary approval, had transported sand illegally. Such acts cannot be encouraged by granting the relief of anticipatory bail.
