Mr.C.K.Suresh Order This petition has been filed seeking transfer of GWOP.No.183 of 2025 from the file of the learned Principal District Judge, Chengalpattu to the file of the learned Principal District Judge at Coimbatore.

2. When the matter was taken up, leaned counsel for the respondent submits that though visitation rights had been granted to the respondent/father, the petitioner/wife is not inclined to permit access to the child. Therefore, he raised an objection to the transfer of the GWOP.

3. According to the respondent, the petitioner is working at Coimbatore and their son is studying in Chaitanya School at Coimbatore. Hence, she wants to transfer the case from Chengalpattu to the District Court at Coimbatore.

4. The facts further reveal that originally the petitioner belonged to Selaiyur, Chennai, while the respondent/father of the child belongs to George Town Chennai. Therefore, invoking the jurisdiction of the learned Principal District Judge, Chengalpattu, the respondent/father filed GWOP seeking custody of the minor child. It is now admitted that the petitioner has remarried and is employed in a private company at Coimbatore. On that basis, she seeks transfer of the case from Chengalpet to Coimbatore. Hence, she is not complying with the order of visitation right which indicates her unwillingness to cooperate.

5. Accordingly, the reasons assigned is not sufficient. Merely because the petitioner has remarried and settled at Coimbatore, the father of the child cannot

be compelled to travel and attend proceedings at the place chosen by the petitioner. Therefore, this court is not inclined to transfer GWOP.No.183 of 2025.
