This present miscellaneous petition has been filed seeking to dispense with the personal appearance of the petitioner in C.C.No.103 of 2023 pending trial on the file of the learned Additional District Munsif-cumJudicial Magistrate, Ambur, Vellore District.

2. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) for the first respondent and the learned counsel for the second respondent.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, the appearance of the petitioner before the trial court is dispensed with except for her appearance for the

purpose of questioning under Section 313 Cr.P.C. and on the day on which M.DHANDAPANI, J.

vji judgment is to be pronounced. However, if for any particular reason, the presence of the petitioner is necessary, the trial court, at its wisdom, shall direct her appearance on those days, however, taking into account the age of the petitioner and the age related ailments being suffered by her.
