(The judgment of the Court was delivered by J.Nisha Banu,J and R.Kalaimathi,J.) This Civil Miscellaneous Appeal has been filed by the appellant/husband against the fair and order passed in I.A.No.4 of 2022 in H.M.O.P.No.140 of 2021 dated 16.02.2023 on the file of the Family Judge, Dharmapuri.
2. When the matter is taken up today, the learned counsel for the appellant would state that the main OP. has been disposed of and the appeal has become infructuous. Therefore, the learned counsel seeks permission to withdraw the appeal. He has also an endorsement for withdrawal of the appeal in the case bundle.
3. In view of the above submission and endorsement made by the learned counsel for the appellant, the Civil Miscellaneous Appeal is dismissed as withdrawn. No costs.
