Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 445 days in filing the restore petition in W.M.P. SR No. of 2022 to restore the above W.P.No. 6122 of 2017 on the file of this Hon'ble Court which was dismissed on 04.12.2020 for non-prosecution (IN WMP.No.10872 of 2022) Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.M.VIVEKANANDAN, Advocate for the Petitioner and of M/S.P.
SATHISH, Additional Government Pleader for the Respondents, the court made the following order:- Being satisfied with the reason stated in the affidavit, the present Miscellaneous petition filed to condone the delay of 445 days in filing the Restoration petition is allowed, subject to payment of a cost of Rs.2,000/- to be paid to the Tamil Nadu State Legal Service Authority, Chennai within a period of two weeks from the date of receipt of a copy of this order and file a proof of such payment before this Court.
2. On filing of such proof, Registry is directed to restore the Writ petition in W.P.No.6122 of 2017. Failing compliance of the said condition, the petition would stand automatically dismissed without further reference to this Court.
